DEED RESTRICTIONS AND CONSTRUCTION REQUIREMENTS

All homes in Oak Estates subdivision are subject to the Amended & Restated Restrictions filed in the Real Property Records of Harris County on June 3, 2024.  The following is a summary of certain of the significant provisions of those Restrictions, but is in no way complete.  Reference is made to the complete version found as the first item in the Architectural Documents section of this website tab.

Construction of any new structures, and certain modifications of existing structures, require written application and approval that the plans comply with all applicable Deed Restrictions and Policies of the HOA. Copies of these Deed Restrictions and Policies, together with information relating to the application and approval process, are listed below.

The Architectural Control Committee is charged with ensuring that all structures and landscaping within Oak Estates are compatible with the character and aesthetics of the neighborhood and conform to the OEHA Dedicatory Instruments.  Each of the Dedicatory Instruments are posted on this section of the website.  No structure may be erected, expanded or reduced prior to submitting application to the ACC and obtaining its approval.  ACC requests may be submitted through your Homeowner Portal under the “Account Info” tab; select the ACC Request option. 

Examples of violations that the ACC will assess fines for include: portacans not covered or not appropriately placed, unfenced construction sites, construction materials blocking the sidewalk, progress in construction prior to submission and approval of required survey/certificate, exterior construction on the weekends, installation of swimming pools or generators, and new fences prior to ACC approval.

The Compliance Committee has responsibility for all non-architectural violations of the Deed Restrictions and other Dedicatory Instruments.  Homeowners are notified of any such violation, such as trash cans inappropriately placed, tree limbs overhanging the sidewalk or impeding a sight line, and lawns that are unkempt, and given an opportunity for compliance within a reasonable time prior to fines being assessed.

The Deed Restrictions also contain restrictions on short term rentals, pet ownership, home based businesses, playground equipment, signs, temporary buildings, and garage sales, among others, that are enforced by the Compliance Committee.

Genesis sends notices of violations of those restrictions to the homeowners, by email and/or U.S. mail, in accordance with the selection for notification made by the homeowner on the Genesis portal.  Fines for violations of the Deed Restrictions are assessed and collected by Genesis in accordance with the Governing Documents Enforcement and Fine Policy listed below.

Homeowners may report suspected violations of the Deed Restrictions to Genesis, for notification to the owner/builder, by calling 713-953-0808 or emailing kristin@genesiscommunity.com. All such reports remain anonymous.
